Does the Charter replace the labour law?
No. Nothing in the Charter reduces any right either side has under the Employment Act of Botswana, the Basic Conditions of Employment Act of South Africa, the Labour Act of Zimbabwe, the Employment Code Act of Zambia, or any other law applying where the work is done. Where the law requires more than the Charter does, the law applies.

The Charter is a code of conduct, not a substitute for the law, and clause eight says so plainly: nothing in it reduces any right either party has under the Employment Act of Botswana, the Basic Conditions of Employment Act of South Africa, the Labour Act of Zimbabwe, the Employment Code Act of Zambia, or any other law applying where the work is done. Where the law requires more than the Charter does, the law wins.
That matters because the Charter is deliberately short and human. It sets a floor of decent conduct that both sides accept before they can use the platform. It does not, and cannot, restate every statutory right an employee or an employer has - and it does not try to sign any of them away. If a legal right and the Charter ever seem to differ, read it the way the clause tells you to: the law is above the Charter.
It also sets Kleana's own place honestly. Kleana is an introducer. It is not the employer, it runs no payroll and it is not a party to the agreement the two sides make. The employment relationship - and the legal rights that come with it - sits between the household and the cleaner.
